1. Who we are

Bestseller Themes (bestsellerthemes.com, the "Website") is operated by LLC Shopipai (შპს შოფიფაი), a limited liability company registered in Georgia, identification code 405758764, legal address: 34 Aleksandre Kazbegi Ave, Saburtalo District, Tbilisi, Georgia ("we", "us", "our").

Bestseller Themes is an independent business. We are not affiliated with, endorsed by, or sponsored by Shopify Inc. "Shopify" is a trademark of Shopify Inc. and is used on this Website only to describe the platform our products are built for.

2. Agreement to these Terms

By using the Website or buying a product, you agree to these Terms of Service, our Refund Policy, our Privacy Policy and our License Terms. If you do not agree, please do not use the Website or buy our products.

You must be at least 18 years old, or the age of legal majority where you live, to make a purchase. If you buy on behalf of a company, you confirm that you are authorized to bind that company to these Terms.

3. Our products

We sell digital products: themes for the Shopify platform ("Themes"), delivered as downloadable files. No physical goods are shipped.

  • Every Theme has a live demo. Please review the demo, description and requirements before you buy.
  • Demo stores may use sample images, fonts or content that are not included in the download unless the product page says otherwise.
  • Themes require an active Shopify store. Shopify subscription fees, apps and third-party services are not included and are your responsibility.

4. License, not sale

When you buy a Theme, you buy a license to use it — not ownership of the Theme or its code. The type of license you choose (Regular or Extended) defines where you may use it. Full details are in our License Terms. All intellectual property rights in the Themes remain with us.

5. Prices, taxes and payment

  • Prices are shown on each product page in the currency displayed at checkout.
  • Applicable taxes, including value added tax (VAT), are calculated and shown at checkout where required by law.
  • Payments are processed securely by our payment provider (currently Flitt). We do not see or store your full card details.
  • We may change prices at any time. Price changes do not affect orders already paid.

6. Delivery

After successful payment you receive a download link by email and on the order confirmation page. Download links may expire after a limited time or number of downloads; if yours has expired, contact us and we will send a new one. If you do not receive your link within 24 hours, check your spam folder and then contact us.

7. Updates and support

  • Updates: All buyers receive free Theme updates (new features, bug fixes and compatibility fixes) for as long as we sell and maintain the Theme.
  • Support: Each purchase includes 6 months of support from the date of purchase. Support covers questions about the Theme's features, help with reported bugs, and guidance on Theme settings.
  • Not included in support: custom design or code changes, installation or configuration of third-party apps, issues caused by code modifications made by you or others, and general Shopify store setup unrelated to the Theme. We may offer such work as a separate paid service.
  • We aim to reply within 1–2 business days (Monday–Friday, Georgia time).

8. Refunds

Refunds are handled according to our Refund Policy.

9. Acceptable use

You agree not to:

  • share, resell, sublicense, redistribute or publish the Theme files, in whole or in part, including on other marketplaces, file-sharing sites or public code repositories;
  • use a Theme outside the scope of your license;
  • remove copyright notices from the Theme files;
  • use the Website for fraud, including unauthorized payments or abusive refund or chargeback requests;
  • interfere with the Website's security or operation.

If you breach these Terms or the License Terms, we may suspend your access to downloads, updates and support, and terminate your license without refund.

10. Accounts

If you create an account, you are responsible for keeping your login details secure and for activity under your account.

11. Disclaimer

Themes are provided "as is" and "as available". We work hard to make them reliable, but we do not guarantee that a Theme will be error-free, compatible with every third-party app, or that it will produce any particular sales result. Shopify may change its platform at any time; we will make reasonable efforts to keep maintained Themes compatible through updates.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, including lost profits, lost data or business interruption, arising from your use of the Website or a Theme. Our total liability for any claim relating to a purchase is limited to the amount you paid for that purchase. Nothing in these Terms limits liability that cannot be limited by law, or your mandatory rights as a consumer.

13. Changes to these Terms

We may update these Terms from time to time. The version published on the Website at the time of your purchase applies to that purchase.

14. Governing law and disputes

These Terms are governed by the laws of Georgia. Disputes will be resolved by the competent courts of Tbilisi, Georgia. If you are a consumer, this does not take away any mandatory protection you have under the laws of the country where you live.
